• up to six months in jail if blood or breath alcohol concentration is below .15
•  **If blood alcohol is above .15 then it is enhanced to a Class A Misdemeanor with a sentence of up to one year
• An annual fee between $1,000-$2,000 for three years to retain your driver license

DWI SECOND:

• Generally classified as a Class A Misdemeanor
• A minimum of 30 days to one year in jail 
• A possible driver's license suspension ranging from 180 days to 2 years
• A maximum fine up to $4,000
• An annual fee between $1,500 to $2000 for three years to retain driver license 

DWI Third (Felony DWI):

• Generally classified as a third-degree felony 
• A range of 2 to 20 years, and 
• Suspension of your driver's license ranging from 180 days to 2 years. 
• An annual fee between $1,500 to $2,000 for three years to retain driver license
