WHAT IS FAMILY OR DOMESTIC VIOLENCE: 

family and domestic violence refers to assault charges including: 

  • Domestic assault or an assault that resulted in bodily injury to a family member 
  • Assault by strangulation 
  • Violation of protective order and, or restraining order 
  • Harassment 
  • Stalking; and 
  • Terroristic threats  


SEVERITY OF FAMILY VIOLENCE CHARGES:

The level of severity of the charge depends on several factors, including: 

  • The amount of injury caused - if the assault only causes bodily injury , than it may be a Class A Misdemeanor; however, if the assault causes serious bodily injury than it may be enhanced to a second-degree felony
  • Whether a deadly weapon was used - this will enhance the charge to a second-degree felony 
  • Previous Convictions - may enhance from Class A Misdemeanor to a third-degree felony
  • Impeding the airway -  enhances from Class A Misdemeanor to a third-degree felony
